TERMS OF USE
This user agreement (hereinafter referred to as the "agreement") regulates the relations between the
administration of the online interactive computer game "Arcane Afterfall" (hereinafter referred to as the "Game"),
located on the Internet website www.arcaneafterfall.com, as well as related to the said game related game resources
(collectively the Game and game resources hereinafter referred to as the "Project") and the user of the Project
(hereinafter referred to as the "Player").
If, in accordance with the laws of your state, you are prohibited from receiving game services online or there are
other legislative restrictions, including age restrictions for admission to such services, you may not use the
Game or individual services in the Game, and undertake to immediately stop using the Game or such services in the
Game.
Any publicly available or additional (paid) services or services in the Game are provided exclusively by the
Game Administration. Receiving game services or services from other third parties may entail a refusal to provide
the Game or Project services to the Player in whole or in part at the discretion of the Game Administration.
If the Player intends to use additional services of the Game or Project in the Game, the Player undertakes to
follow all instructions attached to the Game or Project on the procedure and methods of payment, including the
rules for entering the number of short text messages (SMS), if such are provided, including, but not limited to,
the procedure for entering lowercase or uppercase letters, spaces, input language. The Game Administration shall
not be liable for the correct fulfillment by the Player of the terms of payment for additional services of the
Game or Project, as these are beyond the control of the Administration. The Player may receive additional services
of the Game or Project subject to the Player paying for such services, while the Administration has the right not
to provide such services, provide them in a limited amount, or limit the Player's receipt of both additional and
basic services of the Game or Project until confirmation of payment for the additional services is received.
The Administration has the right to close and/or limit the functionality of the Game or the Project at any time without any prior notice to the Players.
For violation of the Agreement or the Rules of the Game or Project, the Player may be immediately, without any
prior notice, denied services for the provision of the Game or Project service, or such services or access to the
Game or Project may be limited in whole or in part.
Receipt of additional (paid) services of the Game or the Project does not exempt Players or visitors of the
Project from compliance with and application of this Agreement or the Rules of the Game or the Project by the Game
Administration, including, but not limited to, the possibility of the Game Administration refusing to provide
services for the provision of the Game or the Project service or such services or access to the Game or the
Project may be limited in whole or in part.
In certain cases, the Administration has the right to transfer data about the Player who violates the Agreement or
current legislation to law enforcement agencies.
The Administration manages the Game and game processes solely at its own discretion. In order to collect
statistical data and identify Project visitors, the Game Administration may track and save information about the
IP addresses of the Player's access to the Project, use technical information files (cookies) placed on the local
terminal of the Player or Project visitor.
Any personal information of the Player, if such was provided to the Administration in any way during the
interaction of the Parties under the agreement, is stored by the Administration solely for the purposes of
executing the agreement and under no circumstances is transferred to third parties except for the purposes of
executing the agreement or in accordance with the requirements of the law.
The Player or visitor of the Project agrees that the Administration may and has the right to request, collect and store, taking into account the provisions of the Federal Law "On the Protection of Personal Data" the personal information of the Player or visitor of the Project. More information about how we store, process and transfer personal information can be found in the Privacy Policy , which is an integral part of this Agreement.
The RULES OF USE OF THE SERVICE set out below are an integral part of the Agreement, compliance with the Game
Rules and instructions of the representatives of the Game Administration, not contradicting this Agreement or the
Game Rules, is mandatory for the Player.
Information on the minimum requirements for the hardware and software necessary for the Player to use the Game is
provided to the Player in advance. The Player confirms his awareness of such requirements and the availability of
the hardware and software necessary to use the Game.
The use of the Game services is carried out by the Player solely independently and on an "as is" basis, i.e. the
Administration is not liable to the Player under any circumstances for any direct and/or indirect damage that may
be (arise) for the Player in connection with receiving the Game service or the inability to receive such service.
The Player is hereby notified that the Game may provide for various sound and/or video effects that, under certain
circumstances, may cause an exacerbation of the said conditions in persons prone to epileptic or other nervous
disorders, and the Player guarantees that he does not suffer from the said disorders, or undertakes not to use the
Game.
The Player is hereby notified that regular long-term (continuous) presence at a personal computer may cause various complications of the physical condition, including weakening of vision, scoliosis, various forms of neuroses and other negative effects on the body. The Player guarantees that he will use the Game only for a reasonable time, with breaks for rest or other measures to prevent the physical condition, if such are recommended or prescribed to the Player.
The Game Administration does not provide any explicit or implicit guarantees that all shortcomings were taken into account and all software errors were identified during the development of the Game, and, based on the above, the Administration makes all reasonable efforts to ensure that the said errors are identified and corrected within a reasonable time. At the same time, the Player who has found such a shortcoming or error, but has not reported its existence to the Administration, and has used it to obtain Game capabilities not provided for by the terms of the agreement or has publicly disclosed the fact of its existence or the nature of its manifestation, is deprived of the rights provided for by the Agreement immediately at the time of such unlawful use or disclosure.
Invalidity of one or more provisions of the agreement, recognized in the established manner by a court decision
that has entered into force, does not entail invalidity of the agreement as a whole for the parties. In the event
that one or more provisions of the agreement are recognized as invalid in the established manner, the Parties
undertake to fulfill the obligations assumed under the agreement in a manner as close as possible to those implied
by the Parties upon conclusion and/or agreed upon amendment of the agreement.
In the event of a change in the legislation governing the relations between the Parties established by the
agreement, the Parties undertake to fulfill the obligations assumed under the agreement in a manner as close as
possible to those implied by the Parties upon conclusion and/or agreed upon amendment of the agreement, including,
but not limited to, the scope of transferred rights, the procedure and methods for obtaining additional Game
services, the terms of Game support or termination of the agreement.
All trademarks and other means of individualization of goods or services used or mentioned in the Game belong to their legal owners. All other rights not explicitly indicated as belonging to third parties belong to the Administration or the legal owners of such rights.
All copyright, related and other rights to the Game, including game characters, game items and accessories, game payment instruments, and the Project as a whole, belong to the Administration, unless otherwise expressly stated. Unauthorized use of the Game or elements of the Game by the Game Administration in whole or in part is prohibited.
All ownership rights and intellectual property rights in relation to the Game, including, but not limited to, any graphic images, photographs, animations, video recordings, sound recordings, music, text, materials accompanying the Game and any parts or copies thereof belong to the Administration or the relevant copyright holders.
All disputes between the parties under this agreement shall be resolved through correspondence and negotiations; if it is impossible to reach agreement between the parties through negotiations, the dispute may be referred by any interested party to the appropriate court of general jurisdiction of Moscow, Russia.
This Agreement may be changed by the Administration without any prior notice. The Player undertakes to check the
Agreement for changes at least once every seven days. If such a check is not made within the specified timeframe
or after reviewing the Agreement (new version of the Agreement) the Player continues to use the Project, it is
considered that the Player has read and agrees to the Agreement (new version of the Agreement).
The Game Administration has the right to send Players electronic messages of an informational or technical nature
related to the Game or the Project.
All interactions within the framework of the agreement are conducted in Russian.
START OF THE GAME MEANS UNCONDITIONAL CONSENT AND CONFIRMATION OF WARRANTIES ON THE PART OF THE PLAYER WITH
RESPECT TO THE PROVISIONS OF THIS AGREEMENT.
The Administration of the Game and the Project is Individual Enterpreneur Leonid Serdtsev
1. General Provisions
1.1. The provisions set out below are mandatory for all participants of the Arcane Afterfall project and are designed to create a favorable climate of communication among members of the gaming community.
1.2. This set of communication rules applies to all aspects of the in-game information space of the Arcane Afterfall project without exception: the Forum (including all new topics and comments to them), character nicknames, game chat, clan names and symbols, as well as any other means of exchanging information, both existing and implemented subsequently.
1.3 The subject responsible for compliance with the communication rules is not only a single account, but also, in the case of serious violations, other accounts whose IP registration / frequent use will coincide with the IP of the violator.
1.4. The executive body responsible for compliance with these provisions is the Administration of the Arcane Afterfall project and a limited number of player moderators.
1.5. These rules come into force from the moment of their publication. All subsequent changes to them come into force from the moment of updating this document. We will additionally notify players of significant changes to the Agreement or Rules in the game news.
2. Within the framework of using the Arcane Afterfall project, the following is prohibited :
2.1. Using obscene language in any form, including veiled.
2.2. Insulting the human dignity of any player or their relatives on religious, sexual, national or other grounds through words or images, as well as disseminating information about the sexual life of players or their relatives.
2.3. Direct or indirect propaganda of fascism, racism, as well as expressing explicit approval of such actions, including through images (symbols).
2.4. Direct and indirect advertising of narcotic drugs, as well as the distribution of any other materials, as well as any call to action that directly or indirectly violates the legislation of the Russian Federation or poses a threat to national security.
2.5. Sexual harassment, messages of an intimate/immoral nature. Compilation and publication of materials of a pornographic nature.
2.6. Distribution of malicious links, as well as advertising of Internet resources and products that are not related to the theme of the Arcane Afterfall world.
2.7. It is prohibited to create and level up referral characters for the purpose of accumulating emeralds on the main character. It is prohibited to use referral characters to purchase additional services in order to receive Emeralds and transfer the purchased services to your character. All such actions are punishable by denial of access to the game for all characters. At the same time, it is permitted to create additional characters as referrals of the first for the purpose of fair use of the Game service.
2.8. Unreasoned criticism of the actions and decisions of the Arcane Afterfall Administration. Deception and misleading
the Arcane Afterfall Administration for any purpose.
2.8.2. Discussion of the actions of the Moderators outside of the specially designated topic on the forum.
2.9. Use of any methods and/or programs that automate the game process and/or full or partial transfer of control of the character to special software tools, including various scripts that implement control commands using the keyboard and mouse, as well as the use of third-party means of communication with the game server that are not posted by the Administration on the Game website.
2.10. Provocation of any actions that contradict the user agreement or any other rules of the Arcane Afterfall project.
2.11. Overt or veiled threats of physical violence in real life.
2.12. Flooding and flaming (messages not on the conference topic, messages that do not carry any special meaning/semantic load, repeated identical messages and expressions, creation of topics with repetitive themes). As well as any other actions that interfere with the objective perception of information (necroposting, etc.), including violations of partial restrictions in some chat channels (see point 3).
2.13. Dissemination of information about the private life of the Administration and participants of the Arcane Afterfall project, such as any personal data, information about place of residence, photographs, etc. (unless there is direct permission from the person whose personal information is disclosed).
2.14. Registering additional characters in order to obtain game advantages that cannot be obtained using only one character.
2.15. Permanently or temporarily transferring your character (account) to another person for a fee or free of charge, as well as managing someone else's character (account) with or without the owner's consent.
2.16. Conducting fights between characters with a known outcome ("pumping"). Only fights by collusion of players are considered pumping; an attack on a clearly weaker player does not apply to this point.
2.17. Dissemination of information about the plot and events of recently published books and TV series, plot twists of games and similar information in public chats ("spoilers").
2.18 Any violation of the rules using the ability to insert images into the forum is considered a violation with additional aggravating circumstances.
3. Using special chat tabs
3.1 If part of a message in a specialized chat tab complies with its rules, but another part violates the rules, such message violates the rules of the chat tab.
3.2. Moderators are advised not to punish for a message in a specialized tab, except in cases where such a message clearly contradicts these rules.
3.3. In the trade chat, it is allowed to write any messages concerning the purchase of goods (game items that are transferred to other players) or services (for example, the purchase of a rare mob or "locomotive"), and it is prohibited to write any other messages.
3.4. In the "group search" tab, it is allowed to write messages regarding the search for a group for any purpose, including for uniting into groups based on interests, for example, "Looking for those who love Merc as much as I do", and it is prohibited to write any other messages.
3.5. In location chats, it is allowed to write messages on any topic that does not contradict these rules, with the exception of trade messages.
4. Application of Punishments
4.1. Violations of any of the points of the Rules of Communication are conditionally divided into three categories: light, heavy, especially heavy. Each of these categories entails a corresponding punishment:
a) Forum Light: Verbal warning / short-term forum silence.
b) Forum Heavy: Long-term forum silence.
c) Forum Extremely Heavy: Long-term forum silence / Long-term or permanent game block of character / Game block by
IP.
d) Game Light: Short-term game silence.
e) Game Heavy: Weekly game silence.
g) Game Extremely Heavy: Long-term or permanent game block of character / Game block by IP.
4.1.1. Violations of the rules in messages when sending gifts and using engraving are considered as game Extremely Heavy violations.
4.2. The decision on the fact of the existence of a violation, on its gradation, as well as on the measure of restraint is made by the Arcane Afterfall Administration and the moderator players individually in each case.
In order to maintain the game atmosphere at the proper level and more comfortable immersion in the fantasy world
of "Arcane Afterfall", we decided to limit the style of writing game nicknames. The character's name can contain from 3
to 12 characters, without the possibility of using numbers or any other characters except for letters in one of
the language layouts (A-Z, a-ya, AZ, az). In the character's name, it is allowed to use up to 2 spaces. Moreover,
regardless of the change in case, your nickname will be automatically converted to a standard form and only the
first letters of each word will remain capitalized. Also, you cannot use several identical characters in a row.
The correctness of nicknames will be under our close control. First of all, we emphasize the inadmissibility of
using foul language, propaganda of fascism, terrorism, drug use or any other violations of the legislation of the
Russian Federation.
In addition to everything, we sincerely advise you to avoid registering logins that are intended to advertise
anything, insult human dignity based on gender, nationality, religion or other characteristics, imitate or
ridicule other people's nicknames, or otherwise offend our sense of beauty.
In the event that you have overlooked these rules or have deliberately ignored them, we reserve the right to take
any measures to eliminate the violation, ranging from forced renaming to blocking the character.
